As an concerned citizen, I urge you to cosponsor both S. 113, the Prescription Pricing for the People Act and S. 127 the PBM Transparency Act. Both of these bipartisan bills are sponsored by Sens. Maria Cantwell (D-Wash.) and Charles Grassley (R-Iowa). Collectively, these bills clarify the enforcement authority of the FTC and other state agencies to bring action against PBMs to ban deceptive PBM practices that drive up the cost of prescription drugs and ensure that the FTC completes its investigation into whether and how consolidation in the PBM and health care marketplaces have led to anti-competitive behaviors.

PBMs are giant for-profit companies whose business practices greatly impact our lives as patients and our local independent pharmacies who play a critical role in our healthcare.

PBMs determine what drugs are covered on a formulary and on what tier, what pharmacies a patient can go to, and how much pharmacies are reimbursed. They even use pharmacy data to steer patients to pharmacies that the PBM owns or has an ownership interest in.

S. 127 prohibits many of these unfair practices and gives the FTC and state attorneys general greater enforcement authorities to ensure PBMs are not using their position to harm patients or to disadvantage their competitors. S. 113 sets a clear deadline for the FTC to complete its 6(b) study into PBMs and their business practices.

These are both common sense bills. I urge you to actively support them by joining as a cosponsor.
